APOLLO GROUP BV (hierna genoemd APOLLO) vindt uw privacy belangrijk. Wij doen er dan ook alles aan uw privacy te waarborgen. Persoonlijke gegevens worden zorgvuldig verwerkt en beveiligd. Hierbij houden wij ons aan de wet en regelgeving op het gebied van de bescherming van persoonsgegevens: de Algemene Verordening Gegevensbescherming (AVG). In deze privacyverklaring staat hoe we omgaan met uw persoonlijke gegevens.

Uitleg van een aantal termen

Persoonsgegevens: een persoonsgegeven is een gegeven aan de hand waarvan een persoon kan worden geïdentificeerd. Voorbeelden van persoonsgegevens zijn: naam- en adresgegevens, e-mailadressen, pasfoto’s, vingerafdrukken en gegevens over iemands ras, godsdienst, strafrechtelijk verleden of gezondheid.

Betrokkene: degene van wie de persoonsgegevens zijn. Binnen APOLLO gaat het dan, in beginsel, over persoonsgegevens van klanten, leveranciers, medewerkers en sollicitanten.

Verwerken: elke handeling die wordt uitgevoerd met persoonsgegevens, van verzamelen tot vastleggen, bewaren, bijwerken, opvragen, raadplegen, doorzenden, verspreiden, gebruiken en vernietigen.

Verwerker: de persoon of organisatie aan wie APOLLO de verwerking van persoonsgegevens heeft uitbesteed. Bijvoorbeeld een ICT-leverancier of administratiekantoor.

Verwerking van persoonsgegevens

Het gebruik van persoonsgegevens is aan strenge regels gebonden. Indien wij persoonsgegevens verwerken of derden in opdracht van APOLLO gegevens laten verwerken, zijn wij verplicht dit vast te leggen in een verwerkingsregister. Bij elke verwerking van persoonsgegevens wordt vastgelegd welke gegevens worden verwerkt, wie hierbij is betrokken en welke beveiligingsmaatregelen zijn genomen.

Wat gebeurt er met uw persoonsgegevens?

De basisregel is dat APOLLO zorgvuldig met uw persoonsgegevens omgaat. Uw persoonsgegevens mogen alleen worden verwerkt door personen die tot geheimhouding zijn verplicht. We verwerken alleen die persoonsgegevens die echt noodzakelijk zijn om de doelen te realiseren waarvoor uw gegevens worden verzameld, nooit meer. Wanneer gegevens voor andere doeleinden worden verwerkt, dan is hiervoor uw uitdrukkelijke toestemming nodig, tenzij de gegevens geanonimiseerd zijn.

Als u persoonlijke gegevens invult op onze website(s) om informatie op te vragen, zullen wij deze informatie uitsluitend gebruiken voor het afhandelen van uw aanvraag. Uw gegevens worden niet gebruikt voor andere doeleinden en nooit aan derden buiten APOLLO verstrekt.

Hoe gaan wij om met uw persoonsgegevens?

APOLLO bewaart uw persoonsgegevens op een veilige wijze, die in overeenstemming is met de geldende wet- en regelgeving. Alleen geautoriseerde medewerkers hebben toegang tot de informatie. Zij zorgen voor een goede beveiliging van uw persoonsgegevens en hebben een geheimhoudingsplicht.

Met welk doel maken wij gebruik van uw persoonsgegevens?

Uw persoonsgegevens worden door APOLLO gebruikt voor de volgende doeleinden:

1. Het uitvoeren van de met u gesloten overeenkomst(en);
2. Het voeren van de administratie alsmede andere interne beheersactiviteiten;
3. Om met u in contact te kunnen treden en te reageren op door u gestelde vragen;
4. Om u te informeren over nieuwe producten en/of diensten van APOLLO;
5. Het voldoen aan de wettelijke verplichtingen, zoals de administratieve bewaarplicht;
6. Verstrekking van gegevens aan derden op basis van wettelijke of contractuele verplichtingen;
7. Het doen van (klant) tevredenheidsonderzoeken en marketingactiviteiten;
8. Het verbeteren van de website en de dienstverlening van APOLLO;
9. Voor het kunnen verzenden van digitale nieuwsbrieven;
10. Het doen uitvoeren van de accountantscontrole;
11. Het verrichten van wetenschappelijk of statistisch onderzoek.

Rechtsgronden voor de verwerking van persoonsgegevens

APOLLO verwerkt alleen persoonsgegevens wanneer:

• Daarvoor een overeenkomst met u is afgesloten;
• Eén van de wettelijke grondslagen geldt;
• U (uitdrukkelijk) toestemming heeft gegeven voor de verwerking;
• Er sprake is van een gerechtvaardigd belang van APOLLO of een derde;

Voor sollicitanten APOLLO

Indien u bij ons solliciteert, geeft u toestemming dat we uw brief en CV mogen bewaren gedurende de sollicitatieprocedure. Na afronding van de sollicitatieprocedure worden de gegevens binnen een maand verwijderd indien u niet voor een functie bij APOLLO in aanmerking komt. Wanneer we uw brief en CV in portefeuille willen houden, vragen we u daarvoor apart om toestemming.

Voor medewerkers APOLLO

Wanneer je bij ons werkt is het noodzakelijk dat we je persoonsgegevens vastleggen, om uitvoering te kunnen geven aan de arbeidsovereenkomst.

Gerechtvaardigde belangen APOLLO

Voor de hiervoor als 4; 7; 8; 9 en 10 genummerde doeleinden beroept APOLLO zich op de grondslag van het gerechtvaardigd belang. Het gerechtvaardigd belang van APOLLO bestaat in die gevallen uit:

• (Directe) Marketingdoeleinden;
• Beveiliging van de gebouwen en eigendommen van APOLLO;
• Beveiliging en beschikbaarheid van de netwerkinfrastructuur aan derde(n); Bijvoorbeeld het beschikbaar stellen van de gastenwifi;
• Fraudepreventie. Controle op de logging van informatiesystemen. Bijvoorbeeld het internetverkeer;
• Kwaliteits- en trainingsdoeleinden;
• Interne audits;
• Wetenschappelijk (of historisch) onderzoek.

U kunt zich tegen deze verwerking verzetten op grond van het recht van bezwaar. Meer informatie over dit recht vind u verderop in deze verklaring.

Uitwisseling van persoonsgegevens

Het doorgeven en ontvangen van gegevens buiten APOLLO

Voor zover er geen sprake is van uw expliciete toestemming of wettelijke verplichting, vindt uitwisseling van gegevens uitsluitend plaats in het kader van de uitvoering van de met u afgesloten overeenkomst of wanneer APOLLO hiervoor een gerechtvaardigd belang heeft.

Verwerking van gegevens door derden

In sommige gevallen worden persoonsgegevens door derden verwerkt, bijvoorbeeld in het geval van softwareleveranciers. In die gevallen blijft APOLLO verantwoordelijk voor het veilig omgaan met de gegevens. APOLLO heeft met dergelijke leveranciers een verwerkersovereenkomst afgesloten, waarin zij duidelijke afspraken heeft gemaakt hoe deze leveranciers met uw persoonsgegevens moeten omgaan.

Geen commercieel gebruik

APOLLO zal uw persoonsgegevens niet verkopen, noch verhuren, verdelen of op een andere manier commercieel ter beschikking stellen aan derden, behalve zoals beschreven in deze privacyverklaring of tenzij met uw voorafgaande toestemming.

Website en Cookies

APOLLO gaat zorgvuldig om met de persoonlijke informatie die u ons geeft. Dit geldt ook voor informatie die u via de website doorgeeft aan APOLLO.

Bezoekersstatistieken

Als u de website van APOLLO bezoekt, gebeurt dit altijd anoniem. Het is dus niet mogelijk om te zien wie de website bezoekt. APOLLO is wel geïnteresseerd in algemene gegevens over het bezoek aan onze website. Het gaat hier bijvoorbeeld om het aantal bezoekers, welke pagina’s het meest worden bezocht of de tijdstippen van het bezoek. APOLLO maakt gebruik van software om bezoekersinformatie te meten en te analyseren.

Op de website van APOLLO staan links naar websites van andere organisaties. APOLLO is niet verantwoordelijk voor de inhoud van deze websites. APOLLO is ook niet verantwoordelijk voor de privacybescherming op die websites of voor diensten die eventueel via die websites worden aangeboden. Gebruik gegevens

De gegevens of sollicitatie die u invult op onze website, gebruiken wij om te reageren op uw vraag of verzoek. De gegevens die u op onze website achter laat, worden uitsluitend gebruikt om uw identiteit als aanvrager vast te stellen en om misbruik door derden te voorkomen.

Sociale media buttons

Op onze website zijn buttons opgenomen om webpagina’s te kunnen delen op sociale netwerken als Facebook en LinkedIn. Deze buttons werken door middel van stukjes code die van Facebook en LinkedIn zelf afkomstig zijn. Door middel van deze code worden cookies geplaatst. Wij hebben daar geen invloed op. Bewaren van persoonsgegevens

APOLLO bewaart uw persoonsgegevens niet langer dan strikt nodig is om de doelen te realiseren waarvoor uw gegevens worden verzameld, tenzij deze gegevens noodzakelijk zijn om te voldoen aan een wettelijke bewaarplicht met daarin voorgeschreven bewaartermijnen.

Beveiliging van persoonsgegevens

APOLLO heeft passende technische en organisatorische maatregelen genomen om uw persoonsgegevens te beveiligen tegen verlies of tegen onrechtmatig gebruik. Wij hebben daarvoor diverse maatregelen genomen waaronder encryptie van data, versleutelde communicatie en behandeling van de data als zijnde vertrouwelijk. Personen die namens APOLLO toegang hebben tot uw gegevens zijn gehouden tot geheimhouding. APOLLO verlangt dezelfde technische en organisatorische maatregelen van haar verwerkers en heeft dit vastgelegd in verwerkersovereenkomsten.

Responsible disclosure

APOLLO besteedt veel zorg aan de beveiliging van haar digitale systemen. Ondanks alle voorzorgsmaatregelen kan het voorkomen dat zich daarin een zwakke plek bevindt. Vindt u zo’n zwakke plek, dan horen wij dat graag van u, zodat wij snel gepaste maatregelen kunnen nemen. Daardoor kunnen wij de privacy van onze cliënten en medewerkers beter beschermen.

Wij vragen u:

• Uw bevindingen te mailen naar marketing@apollobv.com,
• Het probleem niet te misbruiken door bijvoorbeeld meer data te downloaden dan nodig is om het lek aan te tonen of gegevens van derden in te kijken, te verwijderen of aan te passen,
• Het probleem niet met anderen te delen totdat het is “opgelost”,
• Alle vertrouwelijke gegevens die zijn verkregen via het lek direct na het dichten van het lek te wissen,
• Geen gebruik te maken van aanvallen op fysieke beveiliging, social engineering, distributed denial of service, spam of applicaties van derden, en
• Voldoende informatie te geven om het probleem te reproduceren zodat wij het zo snel mogelijk kunnen oplossen. Meestal is het IP-adres of de URL van het getroffen systeem en een omschrijving van de kwetsbaarheid voldoende, maar bij complexere kwetsbaarheden kan meer nodig zijn.

Wij beloven het volgende:

• Wij reageren binnen 2 weken op uw melding. U krijgt van ons een beoordeling van de melding en een verwachte datum voor een oplossing.
• Wij ondernemen geen juridische stappen aangaande uw melding, mits u zich aan bovenstaande voorwaarden houdt.
• Wij behandelen uw melding vertrouwelijk en delen uw persoonlijke gegevens zonder uw toestemming niet met derden.
• Wij houden u op de hoogte van de status van de kwetsbaarheid.
• In berichtgeving over het gemelde probleem zullen wij, indien u dit wenst, uw naam ver melden als de ontdekker.

Wij streven ernaar om alle kwetsbaarheden zo snel mogelijk op te lossen. Wij worden graag betrokken bij een eventuele publicatie over het probleem nadat het is opgelost.

Uw Privacyrechten

Op grond van de wet heeft u diverse rechten. We zetten deze rechten voor u op een rijtje.

Inzagerecht

U heeft het recht de door APOLLO verwerkte persoonsgegevens in te zien.

Correctie- en verwijderingsrecht

U heeft het recht gegevens te laten wijzigen of zelfs verwijderen indien de gegevens niet (langer) juist zijn, of indien de verwerking niet (langer) gerechtvaardigd is.

Recht van bezwaar

Het recht van bezwaar houdt in dat u vanwege uw specifieke situatie bezwaar kunt maken tegen bepaalde verwerkingen van uw persoonsgegevens. U heeft dit recht bij alle verwerkingen die niet zijn gebaseerd op uw toestemming, de uitvoering van de met u gesloten overeenkomst, het voldoen aan wettelijke verplichtingen of het beschermen van vitale belangen van uzelf of anderen.

Wanneer u bezwaar maakt tegen het gebruik van uw persoonsgegevens om u te informeren over activiteiten van APOLLO dan zullen wij dit bezwaar altijd honoreren. Hetzelfde geldt voor bezwaar tegen soortgelijke verwerkingen. Uw gegevens zullen vervolgens niet langer voor de (direct) marketingdoeleinden worden gebruikt.

Recht op beperking

U heeft onder omstandigheden ook het recht op de beperking van de verwerking van uw gegevens. Dit houdt in dat APOLLO de verwerking van uw gegevens tijdelijk “bevriest”. U kunt dit recht inroepen in vier situaties:

• In afwachting van de beoordeling van een correctieverzoek;
• Indien gegevens eigenlijk gewist zouden moeten worden, maar u geen verwijdering wenst;
• Indien APOLLO de gegevens niet langer nodig heeft, terwijl u de gegevens wel nodig heeft voor de voorbereiding op een rechtszaak;
• In afwachting van de beoordeling van een bezwaar.

Recht op gegevensoverdraagbaarheid

U heeft het recht om de door u aan APOLLO verstrekte gegevens (terug) te ontvangen in een gangbaar bestandsformaat. Dit recht geldt alleen voor de persoonsgegevens die wij van u verwerken op grond van uw toestemming of een met u gesloten overeenkomst. Het recht geldt bovendien alleen voor de gegevens die wij in digitale vorm verwerken (dus niet voor ‘papieren’ verwerkingen). U bent vrij die gegevens vervolgens door te geven aan een andere partij.

Intrekken van toestemming

Voor de gegevens die wij verwerken op basis van uw toestemming heeft u op elk moment het recht deze toestemming in te trekken. Wij zullen de verwerking dan onmiddellijk staken. Een belangrijke uitzondering is dat toestemming die u geeft voor opname van bijvoorbeeld een portretfoto bij een interview of deelname aan bijvoorbeeld een bedrijfsfilm niet ingetrokken kan worden.

Het intrekken van de toestemming heeft geen terugwerkende kracht; alle verwerkingen die al hebben plaatsgevonden blijven dus rechtmatig.

Uitoefening van de rechten

Het uitoefenen van de rechten is voor u in principe kosteloos, behalve bij misbruik. U kunt gebruik maken van uw rechten door contact op te nemen met APOLLO via mailadres marketing@apollobv. com.

Termijnen

Wij zullen uw vragen en verzoeken in beginsel binnen een maand beantwoorden. Wanneer de beantwoording van uw vraag of verzoek meer tijd kost, dan zullen wij u daar binnen een maand over informeren.

Controleren identiteit

Voordat wij uw verzoek in behandeling nemen, zullen wij – zo nodig – controleren wie u bent. In voorkomend geval zullen wij u vragen om uw identiteitsbewijs te laten zien of om een kopie daarvan op te sturen. Dit doen wij om te voorkomen dat we persoonsgegevens aan de verkeerde persoon verstrekken of ten onrechte wijzigingen aanbrengen in uw persoonsgegevens. De kopie van uw identiteitsbewijs wordt gebruikt om uw identiteit vast te stellen. Na vaststelling wordt de kopie direct vernietigd. Wij adviseren u uw pasfoto en Burgerservicenummer op de kopie af te schermen.

Individuele afweging bij ieder verzoek

We wijzen u er op dat de hiervoor beschreven rechten geen absolute rechten zijn. Er kunnen omstandigheden zijn die maken dat we aan een bepaald verzoek geen gehoor kunnen geven. Wanneer wij aan een bepaald verzoek geen gehoor (kunnen) geven, dan zullen we u daarover uiteraard gemotiveerd informeren. Het recht van bezwaar tegen gebruik van gegevens voor (direct) marketing doeleinden is wel absoluut. Een dergelijk bezwaar zullen wij altijd honoreren.

Klachten

Wanneer u van mening bent dat APOLLO niet juist omgaat met uw gegevens, kunt u een klacht bij ons indienen. Uw klacht kunt u richten aan mailadres marketing@apollobv.com. Het staat u verder altijd vrij een klacht in te dienen bij de toezichthouder. De toezichthouder op de privacywetgeving is de Autoriteit Persoonsgegevens. Wijzigingen

Wij behouden ons het recht voor om wijzigingen aan te brengen in onze privacyverklaring. Check daarom regelmatig de privacyverklaring voor een update van ons privacy beleid.

Explanation of some terms

Processing of personal data

The use of personal data is subject to strict rules. If we process personal data or have third parties process data on APOLLO's instructions, we are obliged to record this in a processing register. For each processing of personal data, it is recorded which data is processed, who is involved and what security measures have been taken.

What happens to your personal data?
The basic rule is that APOLLO handles your personal data with care. Your personal data may only be processed by persons who are obliged to maintain confidentiality. We process only those personal data that are truly necessary to realise the purposes for which your data are collected, never more. If data is processed for other purposes, this requires your explicit consent, unless the data is anonymised.

If you enter personal data on our website(s) in order to request information, we will only use this information to process your request. Your data will not be used for other purposes and will never be provided to third parties outside APOLLO.

How do we handle your personal data?
APOLLO stores your personal data in a secure manner in accordance with applicable laws and regulations. Only authorised staff have access to the information. They ensure proper security of your personal data and have a duty of confidentiality.

For what purpose do we use your personal data?
Your personal data are used by APOLLO for the following purposes:

Exchange of personal data

Passing on and receiving data outside APOLLO
Insofar as there is no question of your explicit consent or legal obligation, exchange of data takes place only in the context of the execution of the contract concluded with you or when APOLLO has a legitimate interest in doing so.

Data processing by third parties
In some cases, personal data is processed by third parties, for example in the case of software suppliers. In such cases, APOLLO remains responsible for the secure handling of the data. APOLLO has entered into a processing agreement with such suppliers, in which it has made clear agreements on how these suppliers should handle your personal data.

No commercial use
APOLLO will not sell, rent, distribute or otherwise make your personal data commercially available to third parties, except as described in this privacy statement or except with your prior consent.

Website and cookies
APOLLO treats the personal information you give us with care. This also applies to information you provide to APOLLO via the website.

Visitor statistics

We ask you:

- Email your findings to marketing@apollobv.com,
- Do not abuse the problem by, for example, downloading more data than necessary to demonstrate the leak or accessing, deleting or modifying third-party data,
- Not sharing the problem with others until it is "fixed",
- Delete all confidential data obtained through the leak immediately after the leak has been fixed,
- Not use physical security attacks, social engineering, distributed denial of service, spam or third-party applications, and
- Provide sufficient information to reproduce the problem so that we can fix it as soon as possible. - - Usually the IP address or URL of the affected system and a description of the vulnerability is sufficient, but more may be required for more complex vulnerabilities.

We promise the following:

- We will respond to your report within 2 weeks. We will provide you with an assessment of the report and an expected date for resolution.
- We will not take legal action on your report, provided you comply with the above conditions.
- We treat your report confidentially and do not share your personal data with third parties without your permission.
- We will keep you informed about the status of the vulnerability.
- In notifications about the reported problem, we will, if you wish, report your name far as the discoverer.
- We aim to resolve all vulnerabilities as soon as possible. We will be happy to be involved in any publication about the problem after it is resolved.

Your privacy rights
Under the law, you have several rights. We list these rights for you.

Right of inspection
You have the right to inspect the personal data processed by APOLLO.

Right of correction and deletion
You have the right to have data amended or even deleted if the data are not (no longer) correct, or if the processing is not (no longer) justified.

Right of objection
The right to object means that you can object to certain processing of your personal data because of your specific situation. You have this right in all processing that is not based on your consent, the performance of the agreement concluded with you, the fulfilment of legal obligations or the protection of vital interests of yourself or others.

If you object to the use of your personal data to inform you about APOLLO activities, we will always honour this objection. The same applies to objections to similar processing operations. Your data will then no longer be used for (direct) marketing purposes.

Right to restriction
Under circumstances, you also have the right to restrict the processing of your data. This means that APOLLO temporarily "freezes" the processing of your data. You can invoke this right in four situations:

Pending the assessment of a correction request;
If data should actually be deleted, but you do not wish deletion;
If APOLLO no longer needs the data, while you need the data for the preparation of legal proceedings;
Pending the assessment of an objection.

Right to data portability
You have the right to receive (back) the data you have provided to APOLLO in a common file format. This right applies only to the personal data we process from you pursuant to your consent or a contract concluded with you. Moreover, the right applies only to the data we process in digital form (i.e. not to 'paper' processing). You are free to subsequently transfer that data to another party.

Withdrawal of consent
For the data we process on the basis of your consent, you have the right to withdraw this consent at any time. We will then cease processing immediately. An important exception is that consent you give for inclusion of, for example, a portrait photo in an interview or participation in, for example, a company film cannot be withdrawn.

Withdrawing consent has no retroactive effect; all processing that has already taken place thus remains lawful.

Exercising rights

Deadlines
We will answer your questions and requests in principle within one month. If answering your question or request takes more time, we will inform you within one month.

Verifying identity
Before we process your request, we will - if necessary - check your identity. If necessary, we will ask you to show your proof of identity or send a copy. We do this to avoid providing personal data to the wrong person or wrongly making changes to your personal data. The copy of your proof of identity is used to establish your identity. Once established, the copy is immediately destroyed. We advise you to mask your passport photo and Citizen Service Number on the copy.

Individual assessment of each request
Please note that the rights described above are not absolute rights. There may be circumstances that prevent us from complying with a particular request. If we do not or cannot comply with a particular request, we will of course inform you of this with reasons. The right to object to the use of data for (direct) marketing purposes is absolute, however. We will always honour such an objection.
